2. Description of Service

Product Merge is an AI-powered platform that enables users to create professional product images, including but not limited to:

  • AI-generated product photography backgrounds
  • Image editing and enhancement tools
  • Campaign and marketing visual creation
  • Image composition and variation generation
  • Platform-specific image adaptation

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion.

4. Credits and Payment

Product Merge operates on a credit-based system:

  • Credits are required to generate images and use certain features
  • Credits are non-refundable and non-transferable unless otherwise stated
  • Unused credits from monthly subscriptions do not roll over to the next billing period
  • Pricing and credit allocations are subject to change with notice

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

5. Intellectual Property Rights

Your Content

You retain all rights to the original images you upload to Product Merge. By uploading content, you grant us a limited license to process and transform your images as necessary to provide the Service.

Generated Content

For paid plan users: You own full commercial rights to images generated through our Service. You may use these images for any lawful commercial purpose.

For free plan users: Generated images are for personal or non-commercial use only. Commercial use requires upgrading to a paid plan.

Our Content

The Service, including its original content, features, and functionality, is owned by Product Merge and is protected by international copyright, trademark, and other intellectual property laws.

6. Acceptable Use

You agree not to use the Service to:

  • Upload, generate, or distribute illegal, harmful, or offensive content
  • Create images that infringe on others' intellectual property rights
  • Generate content that is defamatory, obscene, or promotes violence
  • Attempt to reverse-engineer, decompile, or hack the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Violate any applicable laws or regulations

7. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times. We may:

  • Temporarily suspend the Service for maintenance or updates
  • Modify or discontinue features with or without notice
  • Experience interruptions due to circumstances beyond our control

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no warranties regarding the accuracy, reliability, or quality of any content generated through the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCT MERGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Product Merge and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or generate through the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and associated data
  • Any unused credits will be forfeited unless otherwise required by law

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Product Merge operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
